 Upcoming Work Items:

•  A section of the concrete for the slope paving at the Mary’s Creek outfall did not pass the 28-day strength test. BDD4 has agreed to permit the concrete to be cored and tested. Cores were recently taken, and the results are still pending.
• Ninyo and Moore, the CMT for the project, has recently cut a series of cores in the asphalt streets of the West Lea Subdivision to determine the average depth of the existing paving.
• This information will be used to determine line-item quantities for a new paving contract. 
• The information will also be used to estimate the probable cost of the paving work

Highlights: 

The Design contract was awarded to IDS Engineering Group on August 22, 2019. The Construction contract was awarded to Reliance Construction Services (Reliance) in October of 2021. The Notice to Proceed was issued January 31, 2022. The project dealt with increased lead times for waterline fittings due to supply chain issues, that caused the delay in the actual start date to March 21, 2022. On September 19, 2022, the Project Management team met with the residents in a Town Hall type meeting to update the progress of the project and answer questions. 

 Upcoming Work Items:

• Reliance will continue to install the 48” storm pipe on Mockingbird Lane until they reach Wingtail Way.
• When Reliance reaches Wingtail Way they will move to the east end of Heron Lane, connect to the newly installed BDD4 storm pipe, and begin installation of 48” storm pipe west along Heron Lane.
• The culvert and paving crews will continue to install culverts and driveways between Meadow Lane and Heron Lane.
• Asphalt patches and driveways will be installed as the drainage work is completed on each street.

Highlights:

The Design contract was awarded to IDS Engineering Group on August 22, 2019. The Construction contract was awarded to Reliance Construction Services (Reliance) in October of 2021. The Notice to Proceed was issued January 31, 2022. The contractor had increased lead times for some of the waterline fittings due to supply chain issues, that caused the delay in the actual start date to March 21, 2022.

• The Contractor began installation of the storm pipe in mid May 2022 once the waterline relocation work on Heron Lane was completed and in service.
• Drainage work began at the newly installed BBD4 storm junction box at the east end of Meadow Lane and has proceeded west along Meadow Lane beyond Bluebird Way.
• Reliance presently has 3 crews on site. The pipe crew is currently installing 42” storm pipe on Meadow Lane. The culvert crew is installing the new pipe culverts for the driveways and sidewalks between West Lea Lane and Meadow Lane. And the paving crew is installing the new driveways after the new culverts have been installed. Reliance has been re-grading the ditches as they complete installation of the storm lines and culverts.
• As part of the project BDD4 is expanding the detention basin, installing the pond under drain system and connection to Mary’s Creek. BDD4 has continued to install new 48” drainage pipe and junction boxes along the east edge of the subdivision. They have progressed to the southern edge of the Mockingbird Lane intersection.

Upcoming Work Item:

• Reliance will continue to install the 42” storm pipe on Meadow Lane until they reach Wingtail Way.
• When Reliance reaches Wingtail Way they will move to the east end of West Lea Lane, connect to the newly installed BDD4 storm pipe, and begin installation of 48” storm pipe west along West Lea Way.
• The culvert and paving crews will continue to install culverts and driveways between Meadow Lane and West Lea Lane and Mockingbird Lane.
• Reliance will continue to connect the waterline offsets once they have completed the pressure testing and disinfection process.

Highlights:

• The Design contract was awarded to IDS Engineering Group on August 22, 2019. The Construction contract was awarded to Reliance Construction Services (Reliance) in October of 2021. The Notice to Proceed was issued January 31, 2022. The contractor had a lead time for some of the waterline fittings due to supply chain issues, that caused the delay in the actual start date of March 21, 2022.
• Reliance began construction by installing 12”, 8”, and 6” waterlines along Heron Lane. The waterlines are being relocated because they conflicted with the proposed storm lines. 
• Reliance has completed installation of 12” waterline west on Heron Lane from Meadowlark Way to Bluebird Way where it reduced to a 6” line to the end of Heron Lane.
• The Contractor has installed 8” lateral waterlines across Heron Lane on Meadowlark Way and Bluebird Way.
• Residential service connections to the new waterlines along Heron Lane are being installed as the work progresses.
• The Project Team (PM, CM and Engineer) conducted a community outreach meeting in the neighborhood on the evening of May 2nd. The contractor provided a short presentation and the Team answered residents’ questions. The meeting was deemed successful, and no questions remained unanswered by the conclusion of the meeting.

Upcoming Work Items:

• Reliance is currently working to pressure test and sterilize the newly installed waterline offsets so they can be placed into service.
• The Contractor will begin installation of the storm pipe in mid May 2022 once the waterline relocation work is completed and in service.
• Drainage work will start at the newly installed BBD4 storm junction box at the end of Meadow Lane and proceed west along Meadow Lane, turning south on Bluebird Way.
• The contractor intends to have 2 crews, 1 crew on each street and they will re-grade the ditches as they complete installation of the storm lines.
• When the drainage crew installing pipe south along Bluebird Way reaches West Lea Lane they will stop, connect to the BDD4 pipe at West Lea Lane and continue west until they reach the intersection of West Lea Lane and Bluebird Way. At that point they will continue south along Bluebird Way.

October

Purpose:

This memo provides information on the West Lea Subdivision Drainage Improvements project’s bid phase and the forthcoming proposed award of a contract for construction to Reliance Construction Services and a contract for Material Testing services to Ninyo Moore. The bids were opened on July 27, 2021 and the contractor has agreed to extend the hold of his bid until the October 25th and beyond if necessary. The project includes work within Brazoria Drainage District 4 Right of Way and therefore includes an Interlocal Agreement with Brazoria Drainage District 4 (BDD4). Finally, the project will require a contract for Construction Materials Testing which will also be presented to Council on the October 25, 2021 agenda. The construction will exceed the project budget, so staff is also requesting a fund transfer and an appropriation to address the budget shortfall.

Recommendation:

Three items will be recommended at the October 25th City Council meeting:

1. Staff will recommend award of Construction Material Testing contract to Ninyo and Moore in the amount of $99,380. 
2. Staff will recommend approving an Interlocal Agreement with BDD4 in the amount of $856,690. 
3. Staff will recommend that Council at the October 25th meeting approve to transfer $490,062 from DR2201 to DR1904, an additional appropriation of $395,344 from Fund 506 Fund Balance, and an additional appropriation of $950,000 from DR1905 to DR1904 and to award the contract for construction to Reliance Construction Services without the cash allowances of $956,000, in the amount of $5,656,673.92.

Highlights:

• 90% plan comments have been addressed.
• The Hydrology & Hydraulic (H&H) models have been completed.
• Continued coordination with Crude Oil Enterprises concerning their gas pipeline. The pipeline is inactive and is scheduled to be removed by the pipeline company prior to the onset of the drainage project.
• Continued coordination with BDD4 concerning the confluence with Mary’s Creek.
• The wetlands assessment is complete.
  • The consultant submitted the Jurisdictional Water and Wetlands Delineation report to the US Army Corp of Engineers (USACE).
  • The consultant applied for the Nationwide Permit (NWP) on February 22, 2021.
• Challenges that may impact the project include
  • Coordination with the USACE. Based on previous experience with USACE and their delayed responses, staff is concerned with the timely issuance of the NWP by the USACE.
  • Continued coordination with the neighborhood representatives.

Upcoming Work Items:

• Final approval of the NWP.
• Final approval of the Crude Oil Enterprise pipeline crossing and their schedule to remove the abandoned pipeline.
• Meet with the neighborhood representatives to discuss and present the ROW encroachments that will need to be addressed with the project.
  • Several residential private pedestrian bridges have been constructed over the drainage ditches by residents. Several of them are in the flow path of the roadside ditch that is restricting the flow of water. Regrading of the ditches as part of the scope of work will require the bridges to be removed and further discussions will occur with the residents on replacement.
  • Some of the mailboxes will need to be moved temporarily to allow the installation of drainage pipe.
  • Sidewalks with culverts extend over the drainage ditches will have to be removed and reinstalled where necessary.

October

Highlights:

• Notice to Proceed for the design of the drainage system was issued on 08.22.2019.
• The project will help with the conveyance of the smaller intense rainfall events.  The project will be meeting the current Engineering Design Criteria Manual for drainage requirements, such as meeting the required 3-year event and the 100-year detention requirements for road side ditches, but there will likely still be flooding of structures with heavy intense longer duration storms as many of the resident's finish floor elevations are below the road elevation.
• The design team prepared for and attended a public meeting with property owners on 11.19.2019, BDD4 attended this meeting but did not contribute at this time.
  • During the meeting the property owner concerns focused on the ditch depth and side slope configuration for mowing and the conflict of ditch and mature trees that are either in the right of way or are in very close proximity to the right of way.  Ditch cross-section must be wide and flat to allow mowing, but this configuration impacts more trees.  Residents expressed more concern for keeping the trees than resolving potential flooding issues.
  • Additional discussions were held with the residents regarding the conversion of an unused, existing public road right-of-way located east of the subdivision to expand the existing drainage basin infrastructure.  Although dedicated as a public road ROW the land is privately owned and residents do not want to allow a larger ditch to be constructed within that area.  The project's ability to expand the existing drainage ditch is critical to resolving the drainage issues.
  • In response to resident's continuing concerns for preservation of existing trees and ability to mow ditches, the project team reassessed and revised the proposed drainage system; adding pipe at the deep end of the ditches to limit the depth of ditches.
  • Partnering with the City's efforts, BDD4 began discussions wit Staff to assist in easement acquisition and opened discussions with property owners.
• The project team attended a second property owner meeting on 01.10.2020 to provide updates to the residents on changes to the proposed solutions in response to their concerns.
  • Subdivision representatives continued to express concern for the potential loss of trees and perceived loss of property to widen ditches.
  • This continued resistance resulted in Staff agreeing to another modification to the plan for the drainage system.
  • This modification added additional drainage pipe in areas where ditch slopes would exceed 3:1 due to depth and limited Right of Way.
  • BDD4 introduced a plan to widening Mary's Creek in the area of the subdivision outfall (Manvel Road to Magnolia Parkway) at BDD4's cost, in addition;
    • BDD4's proposal included increasing the size of the existing drainage ditch/detention pond east of the subdivision.
    • The proposal requires all 18 residents that own property along the eastern boundary of the subdivision to sign easement agreements with BDD4 to change the road easement to a drainage easement.
      • Currently 12 owners have signed, as of the memo, 4 have not.  Meetings are being conducted with these 4 outstanding residents in an effort to complete this re-assignment.
  • The design consultant has completed hydraulic and hydrologic (H&H) modeling and is coordinating those results with BDD4's engineer for a total model of the entire system at this location.  This will be used to configure the system outfall and operation of the detention pond.
  • The design consultant is also coordinating with TxDOT to obtain agreement to include the cleaning and regrading of the drainage ditch along Manvel Road as part of the overall project scope.
• Efforts to accommodate resident's concerns through these major modifications to the design on two occasions have increased construction costs.  BDD4 has accepted the costs of modifications to the creek and construction of the detention pond and modified outfall.  Within the subdivision, costs to install drainage pipe, not originally included in the preliminary engineering report, have increased the overall cost of the City's portion of this project.  The scope of work required has increased significantly due to the addition of the partnerships with BDD4 detention work and now looking at converting some of the roadside ditches to underground piping as the water is discharged to the detention basin.

Upcoming Work Items:

• The engineer will coordinate with BDD4 to finalize H&H area model with the latest drainage design and resident imposed constraints.
• 60% plan submittal was received October 6th and is under review at this time.
• Continue discussions with the representatives from the subdivision to obtain the drainage easements and maintain communication regarding progress.
• Continued coordination with BDD4 and their plan to widen Mary's Creek at this location.
• Continued coordination with TxDOT to perform maintenance on the Manvel Road ditch.

• An informational meeting with residents was held on November 18, 2019, with a brief PowerPoint presentation.  Frequently Asked Questions and Comment Cards were distributed to attendees.  Comments were collected and will be responded to on this site.  Additional comments may be sent to the project team by downloading the Comment Card, completing it, and mailing to the address shown.
• Representatives of the project team and several members of the community are forming a Committee dedicated to ongoing coordination for and cooperation on this project.  The first meeting is scheduled to take place in January 2020.
• Meeting Notice
  • Residents of the West Lea Subdivision are invited to an Informational Meeting where Project Managers will present a brief overview of the project along with a few exhibits and answer any questions.
