Highlights:

•  On May 8, 2023 (Resolution No. R2023–95) the City awarded a contract to R Construction Civil, LLC for construction services.
•  On July 10, 2023 (Resolution No. R2023–94) the City awarded a contract to Aguirre & Fields, LP for construction management and inspection services.
•  The Notice to Proceed was issued on November 27, 2023 to R Construction Civil, LLC to begin construction work.
•  On March 19, 2024 (Resolution No. R2024-60) the City approved Change Order 1 which added $499,550.58 to the project’s construction budget. 
•  R Construction Civil, LLC has started the construction of the bridge super structure, 100% of the Beams are installed, 60% of the precast concrete panels are installed. The Contractor has completed the headwall and the channel lining in the BDD4 ditch and also completed 50% of the ditch regrading within the BDD4 channel. The Contractor has completed 75% of the concrete paving and sidewalk, and 90% of the stage 2 inlets. 

Upcoming Work Items:

•  R Construction Civil, LLC will continue constructing the new Bailey Road bridge superstructure over the Burlington Northern Santa Fe railroad with the installation of precast concrete bridge deck panels, bridge railings, and roadway and sidewalk concrete paving on top of the bridge deck.
•  R Construction Civil, LLC will resume roadway paving on eastbound lanes of Bailey Road, from Wells Road to the edge of bridge abutment, west of the railroad track and from the entrance of the Alexander development to the edge of bridge abutment, east of the railroad track. Additionally, sidewalk concrete paving along the same sections will resume.
• R Construction Civil, LLC, subsequent to superstructure and eastbound lane construction, will begin the bridge abutments with roadway and sidewalk paving connecting the new Bailey Road bridge to the new roadway on eastbound side, to be followed by roadway concrete paving, raised medians, and landscaping.

•  R Construction Civil, LLC has completed the drill shafts for the new vehicular bridge of Bailey Road east of the Burlington Northern Santa Fe (BNSF) Railway Company’s tracks and installed 3,188 linear feet of 8’x5’ reinforced concrete boxes (RCB) for the stormwater main. 

Upcoming Work Items:

•  R Construction Civil, LLC will continue installing drill shafts for the new bridge of Bailey Road west of the BNSF’s tracks and the 8’x5’ RCB stormwater main.
•  Bridge columns and abutments construction to follow after all drill shafts are completed. The drill shafts installation should be complete by the end of March, 2024.
•  Outfall stormwater structure construction will begin once the 8’x5’ RCB stormwater main is completed. The anticipated start of the outfall installation is the end of April, 2024.
•  Replace the existing water main crossing at Wells Drive/Bailey Road intersection with a new water main pipe.
•  A forthcoming construction change order in the amount of $499,550.58 will be presented to City Council for consideration at the March 25, 2024 meeting. The change order is necessary to account for construction quantity deficiencies on the original bid form. The cost will be at the bid unit prices included in the contract. Funding for this change order will be covered by the project budget under the contingency. Below is a list of the construction pay items and the quantity deficits:

1.  Excavation and backfill for the roadways – 3,650 cubic yard
2.  8’x5’ RCB stormwater main – 184 linear feet
3.  36” drill shaft for roadway bridge – 160 linear feet
4.  Concrete abutment for roadway bridge – 8 cubic yard
5.  Prestressed concrete girder for roadway bridge deck – 407 linear feet
6.  Concrete riprap for stormwater outfall – 51 cubic yard
7.  Roadway bridge railings – 73 linear feet 

The construction manager and inspection team, Aguirre & Fields, LP, discovered the construction quantity deficiencies as they review monthly invoices against construction plan and pay items. A detailed Project Contingency 3% 553,358 Project Balance - Design Start August 2019 October 2019 Bid Start June 2021 February 2023 Construction Start November 2022 November 2023 Proposed Construction Completion November 2024 April 2026 description of the pay items and the cost of the additional quantities for each will be included in the forthcoming change order.

Background:

Bailey Road expansion between Veterans Drive and State Highway 35 is slated for construction as part of the City’s Thoroughfare Plan. As such, Bailey Road is to be built as a four lanes divided roadway with a raised median and was divided into two phases. Phase 1 consists of building a two (2) lanes roadway with a bridge over Burlington Northern Santa Fe (BNSF) railroad on the north side and was completed in 2007. Phase 2 (this project) consists of building the remaining two (2) lanes on the south side with a bridge over BNSF railroad and is part of the 2019 Bond Referendum.

On August 12, 2019 (Resolution No. R2019–203), the City authorized a professional services contract to Freese and Nichols, Inc. (FNI) to prepare construction plans for Phase 2 of Bailey Road between Veterans Drive and State Highway 35. The construction plan was completed and accepted by staff in February 2023. 

Current Status:

Advertising of construction bid for the project followed the City’s standard policy of two (2) consecutive weeks, February 8, 2023 and February 15, 2023. A mandatory pre–bid conference was held at City Hall, Council Chamber on February 16, 2023.

The project utilized the Lowest Responsible Bidder (Texas Local Government Code Chapter 271), subchapter (B) process. Bids were opened on March 7, 2023. Three (3) contractors submitted bids ranging from $13,559,439 to $18,530,000.

R Construction Civil LLC was the apparent responsible low bidder, submitting the bid of $13,559,439.11 which is approximately 6% above the engineer’s construction estimate of $12,829,519

FNI has contacted the references provided and received positive feedback on their performance of similar size and scope projects. The Engineer has reviewed the bids and provided a Recommendation to Award letter for R Construction Civil, LLC.

With the complexities involved in constructing a roadway bridge over an active railroad and the coordination required, it is advisable that a dedicated Construction Manager be assigned to this project. This will ensure the project to be built in conformity to the contract documents, timely and safe manner, quality control, and within budget. The contract for Construction Management services will also include construction inspection and construction material testing.

Aguirre & Fields, LP (Aguirre & Fields) was selected utilizing the City’s Qualification Based Selection (QBS) process as the most qualified firm to perform construction management. Aguirre & Fields experience in design and construction management of roadway bridges statewide make the firm the best qualified for this construction management effort.

Staff worked with Aguirre & Fields to identify the specific scope of work. Based on these discussions, Aguirre & Fields submitted a proposal for construction management/inspection/material testing services of Bailey Road Expansion project in the amount of $1,660,201.90, based on Cost Plus Fixed Fee not to exceed. The fee is approximately 12.3% of the total cost of construction. Staff reviewed the proposal and find it to be fair and reasonable.

Next Steps:

Staff will present the construction bid and construction management proposal to Council at the April 24, 2023 regular council meeting and recommend an approval and award of the contract for construction services to R Construction Civil, LLC in the amount of $13,559,439.11 and construction management services to Aguirre & Fields, LP in the amount of $1,660,201.90. Upon approval of the contracts by Council, staff plans to issue a Notice to Proceed (NTP) to R Construction Civil, LLC and Aguirre & Fields, LP in June 2023 to begin the construction. Construction is expected to commence immediately upon receipt of the NTP with the project to be substantially completed in approximately 29 months.

Highlights:

Phase 1 of the Bailey Road expansion, Veterans to FM1128, was substantially complete in August 2017. This phase of the project diverted a portion of Cowart’s Creek (the roadside ditch) to a new route constructed by Brazoria Drainage District #4 (Cowart’s Creek Diversion Ditch). TxDOT Environmental applied for and was granted a Categorical Exclusion for that portion of Cowarts Creek within the limits of the project. Despite this prior exclusion, the US Army Corps of Engineers (USACE) current determination for the remaining portion of Cowart’s Creek, between Wells Dr and Veterans Rd, is protected and a navigable Waters of the U.S. Freese & Nichols (FNI) has submitted a similar request for this remaining portion of Cowarts Creek and is awaiting USACE’s re-evaluation.

• Under the current determination, any work performed within the drainage ditch would need to be 100% mitigated via purchase of stream mitigation credits, only available in the Katy Prairie Stream Bank. This purchase would require 150% of the length of original stream, since the bank is in a secondary service area, estimated at approximately $8M.
• Staff is working on two options:

              ▪ A) Realign Cowart’s Creek south of the existing alignment. Requires the purchase of additional Right-of-Way                    south of the existing roadway where the ditch would be relocated

              ▪ B) Pursue the Categorical Exclusion through USACE. The application has been submitted and is pending                        Corps’ comment.

Upcoming Work Items:

 • Key changes and additional services are:

• A short run of dual 8’x5’ box culverts will tie-in to the existing headwall East of Veterans Drive to redirect flows into the relocated channel that consists of a 12-foot bottom and 4H:1V slopes.
• Existing storm sewer outfalls along Bailey Rd will be extended further to the south to the newly relocated ditch.
• The relocation of this channel will encroach on existing adjacent detention ponds and will require regrading as well as new drainage calculations to be computed. In addition, the H&H analysis will need to be revised and the drainage report resubmitted to BDD4.
• Geotechnical borings, to include land clearing and grubbing to accomplish task, and lab testing of existing and proposed ROW. (Geotech has proposed 5 weeks to complete report from notice to proceed).

Highlights:

• 90% construction plans, cross sections and technical specifications were submitted for review January 13, 2021. Staff comments are pending receipt of the revised drainage report which uses the current model, as it is being updated due to BDD4 area improvements to the detention basins.
• Consultant has continued the BNSF Structures Review process by coordinating with BNSF personnel on current Union Pacific Railroad (UPRR) Joint Guidelines for Grade Separation Projects for the overpass. Comments from BNSF on the application have been received by consultant and revisions are being addresses for resubmittal.
• Preliminary irrigation and landscaping design for the median improvements have been submitted for staff review.
• Plans have been submitted to utility companies as part of the continued utility coordination process. No conflict letters have been received from AT&T and CenterPoint Energy.
• The consultant (Freese & Nichols) is planning a conference with the U.S. Army Corps of Engineers (USACE) regarding the diversion of Cowarts Creek through previous projects and the recognition that the remaining roadside ditch is no longer a part of the Waters of the U.S. The outcome of that meeting will have implications for the type of permit required for the project, Nationwide 14 or Individual Permit (IP). If the USACE finds for the IP the environmental could cost the project a year for approvals. Staff has previous approvals from the construction of the Bailey Road project and the Cowarts Creek Diversion Ditch project that are being provided during this review process.

• Consultant to address 90% remarks and incorporate Staff comments in 100% design submission.
• BNSF to complete review process on overpass plans.
• Environmental coordination with Army Corps of Engineers began in January, and a pre-application meeting has been requested.

• Design has been finalized for the 10' sidewalk along southside ROW in conjunction with the Multi-Modal Trail master plan.
• Consultant included additional fire hydrants to design to be located on the south side of the street.
• 60% construction plans, cross sections and preliminary drainage report were submitted for review September 23, 2020.  Staff performed an internal design review meeting October 21, 2020 and a plan review meeting was held with the consultant October 23, 2020 to discuss comments.
• Consultant has initiated the BNSF Structures Review process by submitting the plan sheets to the railroad and have been coordinating with BNSF personnel on current Union Pacific Railroad (UPRR) Joint Guidelines for Grade Separation Projects for the overpass.
• Staff requested a proposal from the Consultant to prepare irrigation and landscaping design services for the median improvements.

Highlights:

• Notice to Proceed for design was issued October 3, 2019.
• Topographic survey has been completed.
• Project and/or structure drawing documents for RR coordination have been created.  This is the initial step notifying the Railroad of plans to cross their Right of Way.
• CL Davis and BNSF are working to clarify and confirm the actual ROW dimensions for permitting purposes due to conflicting documentation.
• 30% construction plans were submitted on March 2, 2020.  Staff performed the design review and a plan review meeting was held with the consultant on April 27th.  Comments were returned to consultant May 18, 2020.

Upcoming Work Items:

• Consultant is working to address 30% review comments and push the design forward.
• Provide 30% plans and utility conflict list to utility companies and initiate the Utility Coordination process for this final phase.
• Official determination from the Corps of Engineers (USACE) needed regarding permit necessity due to (3) canal/ditches flowing from Cowart's Creek that cross the project.
• Submit preliminary overpass depiction to BSNF RR.
• Complete draft copy of Drainage Report.
• Sidewalk on the southside to be 10' as was coordinated with the Multi-Modal Trail master plan.

Freese and Nichols was selected to conduct the Preliminary Engineering Report. They performed well and has been selected to provide design services for this project.
