Shadow Creek Trail Phase II

Purpose:

This memo provides information about the progress of the Shadow Creek Trail Phase 2 – Along Clear Creek Relief Ditch project status and the forthcoming proposed contract for construction services provided by Tandem Services, LLC, in the amount of $1,830,530.25. This contract is scheduled for presentation to the Council on the February 26, 2024 meeting agenda.

Background:

Shadow Creek Trail Phase 2 – Along Clear Creek Relief Ditch provides a trail connection between the Shadow Creek Ranch Trail system and the Clear Creek Trail system. This trail connection will provide safe multi–modal mobility and connectivity for pedestrians along the thoroughfares and collector roads within the City's Tax Increment Reinvestment Zones (TIRZ) No.2 area. Thus, this project is reimbursed by the TIRZ No. 2.
On October 26, 2020, the City authorized a professional services contract to Gauge Engineering, LLC to prepare a construction plan for Shadow Creek Trail Phase 2 – Along Clear Creek Relief Ditch (Resolution No. R2020–215). The construction plan was completed and accepted by staff in October 2023.

Current Status:

Advertising of construction bid for the project followed the City’s standard policy of two (2) consecutive weeks, November 15, 2023, and November 22, 2023. A mandatory pre–bid conference was held at the Engineering and Public Works Service Center on November 28, 2023.
The project utilized the Lowest Responsible Bidder (Texas Local Government Code Chapter 271) subchapter (B) process. The bid was opened on December 4, 2023. One (1) bidder, Tandem Services, LLC, submitted a bid of $1,830,530.25 and is the apparent responsible low bidder. Tandem Services, LLC's bid is approximately 2.48% above the Engineer's construction estimate of $1,786,233.75.

Tandem Services, LLC currently has a contract with the City for the Willowcrest Subdivision Paving, Drainage, and Sanitary Improvements project and has performed successfully for the City on past projects.
Gauge Engineering, LLC has contacted the references provided and received positive feedback on their performance of projects of similar size and scope. The Engineer has reviewed the bids and provided a Recommendation to Award letter for Tandem Services, LLC.

Next Steps:

Staff will present the construction bid to the Council at the regular Council meeting on February 26, 2024, and recommend approval and award of the contract for construction services to Tandem Services, LLC, in the amount of $1,830,530.25. Upon approval of the contract by Council, staff plans to issue a Notice to Proceed (NTP) to Tandem Services, LLC, in March 2024 to begin the construction. Construction is expected to commence immediately upon receipt of the NTP, with the project to be substantially completed in approximately 13 months. This project will include the construction of a prefabricated pedestrian steel truss bridge to cross over the Clear Creek Relief ditch. The lead time for the bridge is approximately 9 months.

Highlights:

Shadow Creek Trail Ph II was split into two segments for bid and construction.

Library Trail:

The library section of the trail was completed within schedule and budget. Partial closeout was issued and handed over to end users.

• 100% of the trail is complete.
• 30’ of RCP was installed.
• Sod was installed.
• Hydro-mulch was complete.
• Trench drain was done, and diamond plate was installed.

Clear Creek Relief Ditch section of the trail:

• Clear Creek Relief Ditch Trail portion is at 95% design completion. Advertisement September 2022. 

The trail once completed will allow the movement of pedestrians beneath Shadow Creek Parkway and provide a connection of the Clear Creek Trail system and the trail system internal to Shadow Creek Ranch neighborhoods.

 Highlights:

• Based on comments received on the 90% plan review in March we will be removing a previously planned pedestrian bridge that is costly and with the new roadway configuration near FM521 does not provide pedestrian value, adding a mid-block crossing on Kingsley, adding a new sidewalk segment within SCR Park in conjunction with a pedestrian crossing of Kingsley and extending the sidewalk south along Kingsley to tie into existing on west side and adding a segment of sidewalk along Business Center Drive north of SCR Parkway to tie into the existing trail along Clear Creek. See attached Kingsley and Business Center Sidewalk Limits exhibits.
• Discussions also determined that the project will most likely require a Local On-System Agreement (LOSA) with TxDOT to allow work to be conducted within portions of TxDOT’s Right of Way were the sidewalk crosses into the Right of Way.

Upcoming Work Items:

• The 90% comments will be included in the 95% submittal and require a contract amendment to the design offset by the cost of removing the pedestrian bridge. The changes will delay the scheduled delivery of 95% plans. Staff is working on this now.
• Gauge will be contacting TXDOT regarding the Local On-System Agreement.
• City Staff are planning to notify property owners along Shadow Creek Parkway of the upcoming project and plans to construct along their frontages.

Highlights:

• This trail will add approximately 1600 feet of 10 foot hike and bike surface connecting the trail along Clear Creek with trails within the Shadow Creek development south of Shadow Creek Parkway passing under the bridge on the Parkway to make that connection.
• The Shadow Creek Trail Phase II – Library Trail segment of the project was extracted from this plan set and included with the Shadow Creek Sidewalk Extension project (Construction NTP March 2022). This action expedited bid and construction phase for the library trail and will allow for use more in line with the opening of the West Pearland Library. 

Upcoming Work Items:

• The 90% plan review meeting will be scheduled within the next 2 weeks to give Gauge Engineering ample time to receive the comments from all stakeholders.
• The 100% plans are expected to be submitted April 2022 with the TRC to directly follow.
• Bidding phase is expected to take place in May 2022.

Highlights:

• Staff received 30% plans from the consultant, Gauge Engineering, on July 27th for review.
     o Plans were submitted to ROW, Community Development, and Engineering Department for review.
     o Gauge submitted plans and a bridge impact analysis to TXDOT, Brazoria Drainage District, and Fort Bend County (Fort          Bend County maintains Clear Creek at this location).
     o Brazoria Drainage District has sent letter of no objections
     o Staff submitted plans and the bridge impact analysis to SCRMA for review.
• Staff presented project details to the Emerald Bay Homeowners annual meeting on November 19 about the upcoming projects within the Shadow Creek area.
• Staff submitted plans to the utility companies for review of potential conflicts

Upcoming Work Items:

• Staff received the draft encroachment agreement from Kinder Morgan pipeline and is currently reviewing.
• Staff is preparing to set up a meeting for all departments to review the 30% plans in the next coming weeks.
